Patient Rights and Responsibilities

The following patient rights and responsibilities have been prepared in accordance with the Patient Rights Regulation dated 16.01.2019 and numbered 30657.

 

Purposes Of Patient Rights

As Emsey Hospital, our aim is to define and inform patients and their relatives about their rights and responsibilities during the period they receive medical services for examination and treatment.

 

Patient Rights And Responsibilities

 

1. Right to Benefit from Healthcare Services

  • The patient has the right to benefit from healthcare services in accordance with the principles of justice and equity, including preventive healthcare services and activities aimed at promoting a healthy life.

 

2. Right to Information and to Request Information

  • The patient has the right to request verbally or in writing information about how and under what conditions they can benefit from healthcare services.

 

3. Right to Choose and Change Healthcare Institutions and Personnel

  • In compliance with applicable procedures and regulations, the patient has the right to choose the healthcare institution and benefit from the services provided therein.

 

4. Right to Privacy and Confidentiality

  • The patient has the right to demand that medical evaluations related to their health condition be carried out confidentially.

 

5. Right to Priority Based on Medical Criteria

  • The patient has the right to have their priority determined objectively and based on medical criteria. Emergency, forensic cases, elderly, and disabled patients have priority in receiving healthcare services.

 

6. Right to Diagnosis, Treatment, and Care in Accordance with Medical Requirements

  • The patient has the right to request diagnosis, treatment, and care in accordance with modern medical knowledge and technology.

 

7. Right to Medical Diligence

  • Healthcare personnel are obliged to provide the medical care required by the patient’s condition. Even if saving the patient’s life or maintaining their health is not possible, efforts must be made to relieve or reduce suffering.

 

8. Right to Review and Request Correction of Medical Records

  • The patient has the right to examine their medical files and records directly, through a proxy, or a legal representative, and to obtain a copy. Such records may only be viewed by those directly involved in the patient’s treatment.

 

9. Right to Consent (Approval)

  • The patient has the right to be informed and give consent before any surgical intervention or treatment, thus participating in their own treatment.

 

10. Right to Refuse or Discontinue Treatment

  • Except in cases mandated by law or emergency, the patient has the right to refuse or discontinue planned or ongoing treatment, accepting responsibility for any negative outcomes.

 

11. Right to Safety

  • The patient has the right to expect and demand safety within healthcare institutions.

 

12. Right to Fulfill Religious Practices

  • Provided that it does not disrupt services, disturb others, or interfere with medical treatments, patients may request a clergy member of their faith for spiritual support. Religious books may also be provided by the Patient Rights Unit.

 

13. Right to Respect for Human Dignity

  • The patient has the right to receive healthcare in an environment that respects human dignity, ensures hygiene, and minimizes disturbing factors such as noise.

 

14. Right to Visitors and Companions

  • Subject to institutional rules, legal regulations, and the approval of the responsible physician, patients have the right to have visitors or companions to the extent allowed by their medical condition.

 

15. Right to Preventive Measures

  • The patient has the right to receive appropriate preventive healthcare services to protect against illness.

 

16. Right to Quality Standards

  • Every individual has the right to benefit from high-quality healthcare services within established standards.

 

17. Right to Avoid Unnecessary Pain and Suffering

  • Every individual has the right to be protected from pain and suffering as much as possible at every stage of their illness.

 

18. Right to Personalized Treatment

  • The patient has the right to be directed to diagnosis and treatment programs tailored to their personal needs.

 

19. Right to End-of-Life Care

  • In terminal stages where cure is not possible, the patient has the right to receive palliative care to relieve discomfort and maintain the highest possible quality of life.

 

20. Right to Application, Complaint, and Legal Action

  • The patient and their relatives have the right to apply, complain, and take legal action in case of violation of patient rights, within the framework of applicable regulations.
 

Responsibilities Of The Patıent And Family

1. General Responsibilities

  • The patient must comply with the treatment plan and recommendations given by their physician for a healthy life.
  • Patients and their families may donate blood, tissues, or organs.
  • In simple cases, individuals should take care of themselves.

 

2. Social Security Information

  • The patient must inform the hospital of any changes in their health, social security, or personal information in a timely manner.

 

3. Informing Healthcare Providers

  • The patient must provide accurate and complete information regarding their medical history, current complaints, treatments received, medications used, and any changes in their condition.

 

4. Compliance with Hospital Rules

  • The patient must comply with the rules of the healthcare institution and procedures applied.
  • The patient must comply with the referral chain determined by the Ministry of Health and Social Security Institutions.
  • The patient is expected to cooperate with healthcare personnel during treatment, care, and rehabilitation.
  • If the patient has an appointment, they must respect the date and time, and notify the hospital in case of changes.
  • The patient must respect the rights of hospital staff, other patients, and visitors.
  • The patient must not damage hospital property; if damage occurs, they are responsible for compensation.

 

5. Compliance with Treatment Recommendations

  • The patient must carefully listen to recommendations about medications and ask questions if unclear.
  • If the patient cannot comply with treatment recommendations, they must inform healthcare personnel.
  • The patient must confirm their understanding of post-treatment care and discharge plans.
  • The patient is responsible for any consequences resulting from refusal of treatment or noncompliance with the treatment plan.

 

6. Responsibility to Pay for Healthcare Services

  • At admission, the patient must provide information about how healthcare costs will be covered. The patient is obliged to pay the amounts due for diagnosis and treatment within the period determined by the hospital.

 

7. Responsibility to Report Communicable Diseases

  • Patients with suspected or diagnosed communicable diseases must not leave the hospital without authorization from their physician.

 

8. Responsibility to Avoid Inappropriate Demands

  • Patients must not request medications or treatments that are not part of the treatment plan and not approved by the physician.

 

9. Responsibility to Comply with Visitor Rules

  • Patients are responsible for accepting visitors only within the framework of the hospital’s rules.
